Employment Law Wellington is a series of rules and regulations that are put in place to ensure that both employees' rights are protecting in the workplace, and to make sure that employers are aware of their obligations to their employees. Should these legalities not be followed, organisations may find themselves in the middle of a daunting employment tribunal.
Within employment law various terms and conditions of employment are laid out to ensure that the employer/employee contract is fair for everyone involved. A key example of this is with an employment contract. When commencing in a new post with a new organisation, an employee is usually asked to sign a contract of employment detailing the terms and conditions of employment. Employees are expected to uphold these terms of employment, and in return the employer is obligated to ensure they maintain the conditions of the employment contract. Nevertheless, these terms and conditions of employment continue through the employment relationship and cover a variety of areas such as employee relations, pay and reward, performance management, recruitment and selection and absence management. To ensure employees are aware of the policies and procedures governing their employment, employers should make sure their policies are available for viewing at all times.
Employment law can also refer to the legal rights of the employee. A perfect example of this is prospective employee rights during the recruitment and selection process. A key example of this is during an interview. Employers are advised that in these situations they should refrain from asking questions regarding equality and diversity e.g. race, religion, sexual orientation etc. This information can be obtained for monitoring purposes; however Recruiting Managers are advised to avoid the subject during interview as answers to these questions have no bearing on an employee's capability to do the job in question.
On the other hand, it is the employer's obligation to undertake pre-employment checks on the candidate prior to confirming their offer of employment.
